In relation to the request for details of the reported incidents, the Scottish Ambulance Service is applying Section 38(1)(b) of the Freedom of Information (Scotland) Act.

An exemption under section 38(1)(b) of FOISA states: information which relates to a living individual other than the applicant for the information will be exempt where the disclosure of the information would breach Article 21 of the GDPR, right to object to processing.

This exemption is subject to the ‘public interest test’. Therefore, taking account of the circumstances of this request, this is not something which is of serious concern and therefore beneficial to the public to breach a Data subject’s rights to object on the use and release of their data.
