Disclosure under FOISA is full disclosure, to the world at large. It cannot be restricted to a particular group or purpose. It is for this reason that we have applied section 30(c) of FOISA in that disclosing previous interview questions and answers for a role within the Scottish Ambulance Service would otherwise prejudice substantially, or be likely to prejudice substantially, the effective conduct of public affairs.
When applying the ‘public interest test’ we consider if it is in the interest of the public for this document to be released and NOT if the document would be of interest to the public.
We have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. The Scottish Ambulance Service acknowledges the public interest in disclosing information as part of an open, transparent and accountable public authority. However, we have found that, on balance, the public interest lies in favour of upholding the exemption. There is potential that this information could be used by candidates to alter their recruitment behaviour in ways which would influence the outcome of the interviews. Withholding this information ensures that all potential candidates have an equal chance during their interviews and confidence remains high that the Scottish Ambulance Service is employing those best qualified for the positions.
