Information Requested

I am writing to request information under the Freedom of Information Act 2000. Please provide the following in relation to your organisation (the Ambulance Trust/Service):  

1. Cases referred to Employment Tribunal (including Early Conciliation) - The number of cases that have been referred to Employment Tribunal, including those currently in the ACAS Early Conciliation period, that are ongoing/open as at the date you process this request (or the most recent date for which you hold a complete record).  

2. Outcomes in the last 12 months - For the last 12 months (rolling from the date you process this request), the number of cases that have:  

  1. a) resulted in a finding of unfair dismissal, and 
  2. b) resulted in any payment by the organisation to the claimant (whether compensation ordered by the Tribunal or a settlement payment), and 
  3. c)resultedin reinstatement or re-engagement (for example, the claimant returning to their role or being re-employed by the organisation, whether ordered by the Tribunal or agreed as part of a settlement).  

 

- If possible, please provide these as separate counts (a, b, and c). If they overlap, please indicate whether the same cases are counted in more than one category, and confirm whether the “payment” figure includes settlements reached before a full Tribunal hearing/outcome.  

Response

As at the date the request was processed, the organisation had 5 Employment Tribunal cases open, including those within the ACAS Early Conciliation process. In the preceding 12‑month period, there were no cases resulting in a finding of unfair dismissal, <5 cases resulted in a payment to the claimant (either through settlement or Tribunal award), and no cases resulted in reinstatement or re‑engagement. 

 

For the given data, you will see that some of the figures are shown as, five or less than five, please note  

that this figure has been suppressed because the statistical value is less than five. The Scottish Ambulance  

service has a duty, under the Data Protection Act to avoid directly or indirectly revealing any personal  

details. It is therefore widely understood that provision of statistics on small numbers, five or less are  

statistically suppressed upon disclosure.
