If the Trust has amended any of these policies following the Supreme Court judgement, I would also appreciate copies of the versions that were in force immediately before those amendments, where readily available.

If the Trust does not hold documents relating to one or more of the above topics, I would be grateful if you could confirm that.

Response

Equality, Diversity and Inclusion

The Scottish Ambulance Service adheres to the NHS Scotland Once for Scotland Equality, Diversity and Human Rights Policy. A copy of the current policy is attached; this will be reviewed once national updates are issued.

Supporting trans staff / transgender staff / gender reassignment

Guidance relating to supporting trans staff is currently under review following the Supreme Court judgment. As the Scottish Ambulance Service follows national NHS Scotland Once for Scotland workforce policies, any revised guidance will be implemented when national updates are issued. In the meantime, staff are signposted to support and resources available through the National Ambulance LGBT+ Network.

Non-binary staff

The Scottish Ambulance Service does not hold a standalone policy or guidance relating specifically to non-binary staff. Relevant support is provided through wider equality, diversity and inclusion resources and the National Ambulance LGBT+ Network.

Inclusive language

The Service has contributed to work undertaken through JRCALC on inclusive language and equality, diversity and inclusion considerations within clinical guidance. Further sector-wide work is anticipated across UK ambulance services.

Use of single-sex facilities, including toilets, changing rooms and showers

The Scottish Ambulance Service does not currently hold a standalone policy relating specifically to the use of single-sex facilities. The Service is currently undertaking an audit of the service estate to consider the implications of emerging national guidance and legal developments.

Pronouns and names

The Scottish Ambulance Service does not hold a policy that set's out the use of pronouns and names.  Information around the use if pronouns in the Scottish Ambulance Service has been shared in a previous FOI - FOI 25-568 SAS Staff use of Pronouns

LGBT+ or Pride staff networks

The Service holds guidance and support materials relating to its LGBT+ staff network. A copy of the attached Pride Starts Here - Redacted has been provided.

Official Trust participation in Pride events

The Scottish Ambulance Service does not hold any policies or documents relating to participation in Pride events.  Pride event participation is undertaken by staff on a voluntary basis and in their own time – further information can be found here FOI 26-305 Pride Month

Guidance or communications issued following the Supreme Court judgment of 16 April 2025

No specific guidance has been issued to staff or managers following the Supreme Court judgment. However, a Chief Executive communication was issued advising staff that national guidance was expected and reaffirming the Service's commitment to supporting all staff and promoting an inclusive working environment. A copy is attached.

Policies under review

As the Scottish Ambulance Service follows national NHS Scotland Once for Scotland policies, local policy reviews will be undertaken in line with any revised national guidance; these have been indicated above. Publication dates for revised national guidance are not currently known.

Previous versions of policies

The Scottish Ambulance Service has not amended any of its policies as a direct result of the Supreme Court judgment of 16 April 2025. Accordingly, we do not hold any superseded policy versions specifically created as a consequence of amendments arising from that judgment.
